Terms of Use

1. Acceptance

By accessing or using the EXACT Agent Portal ("Portal"), you confirm that you are an authorised representative of a retail outlet or aesthetic practice that has entered into a commercial agreement with Precision Skin LLC SPC ("EXACT", "we", "us"). Your continued use of the Portal constitutes acceptance of these Terms of Use in full.

If you do not agree to these terms, you must not access or use the Portal.

2. Authorised Use

Access to the Portal is granted solely for the purpose of managing client orders, skin analysis data, and production batches on behalf of your retail outlet. You agree to:

Use the Portal only for its intended commercial purpose
Maintain the confidentiality of your login credentials and not share access with unauthorised persons
Promptly notify EXACT if you suspect unauthorised access to your account
Comply with all applicable laws, including those governing the collection and processing of personal and biometric data

3. Prohibited Conduct

You must not:

Attempt to circumvent, disable, or interfere with any security feature of the Portal
Use the Portal to process data of individuals who have not given informed consent
Export, copy, or redistribute client data outside the Portal without authorisation
Reverse-engineer, decompile, or attempt to extract the source code of any component of the Portal
Use automated tools, bots, or scrapers to access the Portal

4. Intellectual Property

All content, branding, formulations, algorithms, and software within the Portal are the exclusive property of Precision Skin LLC SPC or its licensors. No licence is granted to you beyond the limited right to use the Portal for its intended purpose.

5. Data Responsibility

You are responsible for ensuring that all client data entered into the Portal has been collected lawfully and with appropriate consent. Precision Skin LLC SPC processes this data as a data processor on your behalf. Please refer to our Privacy Policy and Data Confidentiality Agreement for full details.

6. Availability & Changes

We endeavour to maintain Portal availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features at any time with reasonable notice. We reserve the right to update these Terms; continued use after notification constitutes acceptance of any changes.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Precision Skin LLC SPC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Portal. Our aggregate liability in connection with the Portal shall not exceed the fees paid by your retail outlet to Precision Skin LLC SPC in the three months preceding the claim.

8. Governing Law

These Terms are governed by the laws of the United Arab Emirates. Any disputes shall be subject to the exclusive jurisdiction of the courts of Abu Dhabi, UAE.
